Please read these Terms and Conditions of Sale carefully before making a purchase on our Site. By placing an order, you declare that you have fully understood and accepted these conditions, which constitute a legally binding agreement between you and Bottega Da Ponte.

1. SELLER'S LEGAL INFORMATION

2. SCOPE OF APPLICATION AND DEFINITIONS

2.1. These Terms and Conditions apply to all product purchases made through the Site.

2.2. Pursuant to current regulations, the following definitions apply:

  • "Consumer" (B2C): a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.
  • "Professional" (B2B): a natural or legal person acting in the exercise of their entrepreneurial, commercial, craft or professional activity, identified by entering their VAT number during the purchase.

3. PRICES AND PAYMENT METHODS

3.1. All product prices are expressed in Euros (€).

3.2. Pursuant to art. 1, paragraphs 54-89, Law 190/2014 and subsequent amendments, prices do not include VAT, as the activity operates under a flat-rate tax regime.

3.3. Prices do not include shipping costs, which are clearly indicated and calculated during the checkout process before order confirmation.

3.4. Payment can be made using the methods available on the Site (including Visa, Mastercard, American Express credit/debit cards, Apple Pay, Google Pay, MyBank and Bank Transfer). Transactions are processed securely through the Shopify Payments platform and its authorized third-party payment service providers. The charge occurs at the time of order confirmation.

4. CONCLUSION OF CONTRACT AND OBVIOUS ERRORS

4.1. The presentation of products on the Site constitutes an invitation to offer. By submitting the order through the Shopify guided procedure, the user makes a contractual purchase proposal.

4.2. The contract is concluded when Bottega Da Ponte sends the user, to the email address provided, the Order Confirmation automatically generated by the system.

4.3. In the event that, due to a technical, human or system error, a product is displayed on the Site with a patently incorrect price (derisory or disproportionate to its actual market value), the order will be considered null and void. In such a case, Bottega Da Ponte will cancel the order, promptly inform the customer and fully refund the amount paid.

5. SHIPPING, DELIVERY AND TRANSFER OF RISK

5.1. Bottega Da Ponte ships products to the address indicated by the user during checkout. Estimated processing and delivery times are indicated on the shipping page and during checkout.

5.2. Delivery times are to be considered indicative and not mandatory. Bottega Da Ponte cannot be held responsible for delays attributable to the courier or force majeure.

5.3. Transfer of risk (Art. 63 Consumer Code): If the user is a Consumer, the risk of loss or damage to the products is transferred to the user only when the latter (or a third party designated by him and different from the carrier) physically takes possession of the goods.

6. RIGHT OF WITHDRAWAL (Return Policy)

6.1. If the user is a Consumer, they have the right to withdraw from the contract, without stating reasons, within 14 (fourteen) days from the day on which the Consumer (or a designated third party) receives physical possession of the goods.

6.2. Method of exercise: In accordance with the current provisions on distance contracts (including Legislative Decree 209 of December 31, 2025 implementing EU Directive 2023/2673), the user can exercise the right of withdrawal in a simplified and immediate way through the dedicated returns portal/form available on the Site. This procedure is accessible and active for both registered users and guest users. The consumer's right to send any other explicit declaration to our contact email remains unaffected.

6.3. Exceptions to the Right of Withdrawal (Art. 59 Consumer Code): The right of withdrawal is strictly excluded for:

  • The supply of sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery (by way of example and not exhaustive: open cosmetic products, creams, care and hygiene products without their original seal or used).
  • The supply of goods made to specification or clearly personalized.

6.4. Condition of goods for return: Products eligible for return must be returned intact, in their original and complete packaging in all its parts (including packaging, documentation and accessories), unused and in conditions suitable for resale.

6.5. Costs and methods of return shipping: Unless otherwise stated in writing, the direct costs for returning the goods are entirely borne by the user. The user is responsible for return shipping until receipt at our warehouses.

6.6. Refund: Once the products have been received and their complete integrity and conformity verified, Bottega Da Ponte will refund the amount paid for the products within 14 days of receiving the goods, using the same payment method chosen by the user at the time of purchase. Pursuant to art. 56 of the Consumer Code, the refund includes the costs of initial standard shipping, while additional costs resulting from the customer's choice of a different and more expensive delivery type than standard shipping are excluded.

7. LEGAL GUARANTEE OF CONFORMITY

7.1. Sales to Consumers (B2C): Products purchased by Consumers benefit from the 24-month Legal Guarantee of Conformity provided for by the Consumer Code. The defect of conformity must be reported to Bottega Da Ponte within 2 months of its discovery.

7.2. Sales to Professionals (B2B): Products purchased by Professional users are covered by the guarantee for defects regulated by the Italian Civil Code, lasting 12 months from delivery, with the obligation to report the defect within 8 days of discovery.

7.3. The warranty does not apply in case of damage caused by improper use, negligence, alteration or failure to observe the product's instructions for use.

8. INTELLECTUAL PROPERTY

All content on the Site (including trademarks, logos, texts, photographs, product descriptions, graphics and software) is the exclusive property of Bottega Da Ponte or its partners/suppliers and is protected by national and international copyright and industrial property laws. Any reproduction, copying or unauthorized use not expressly authorized in writing by Bottega Da Ponte is prohibited.

9. ONLINE DISPUTE RESOLUTION (ODR)

Pursuant to art. 14 of EU Regulation no. 524/2013, Consumers are informed that the European Commission has established an online platform for alternative dispute resolution (ODR), accessible at the following official link: https://ec.europa.eu/consumers/odr. Through this platform, Consumers can manage and resolve disputes relating to contracts concluded online out of court.

10. APPLICABLE LAW AND COMPETENT JURISDICTION

10.1. These Terms and Conditions and sales contracts are governed by Italian law.

10.2. Consumer Forum (B2C): For any civil dispute arising from the interpretation or execution of these Terms between Bottega Da Ponte and a Consumer, the mandatory territorial jurisdiction belongs to the court of the Consumer's place of residence or domicile, if located in the territory of the Italian State.

10.3. Professional Forum (B2B): For any dispute between Bottega Da Ponte and a Professional user (companies/VAT holders), the parties establish the exclusive jurisdiction of the Court of Vicenza (VI).

11. MODIFICATIONS TO THE TERMS AND CONDITIONS

Bottega Da Ponte reserves the right to modify the initial Terms and Conditions at any time to adapt them to new legal provisions or changes in the Site's functionalities. The new conditions will be effective from the moment of their publication on the Site and will apply exclusively to orders placed after such publication.
